Terms of Service

The agreement between you and wagr — what wagr is, what it is not, and how money never passes through it.

These terms are an agreement between you and [LEGAL ENTITY NAME] (“wagr”, “we”, “us”). By creating an account or using the app, you accept them. If you do not accept them, please do not use wagr.

1What wagr is — and what it is not#

2Eligibility#

  • You must be 18 years of age or older.
  • wagr is offered only in the United States. Do not use it elsewhere.
  • You are responsible for ensuring that your use of wagr is lawful where you live. Laws on wagering between individuals vary by state and can change. If it is not lawful where you are, do not use wagr.
  • You must not be barred from using the service under applicable law, and must not have been previously removed from wagr.

3Money never passes through wagr#

This is worth stating in its own section because it defines what we can and cannot do for you.

  • All settlement happens directly between you and the other person, outside the app, by whatever means you both choose.
  • The Venmo and PayPal options in wagr are convenience links. Tapping one opens that app on your device. wagr does not process, route, guarantee or verify the payment, and receives no confirmation from those services.
  • When wagr shows a wager as paid or settled, that reflects what you and the other person told the app — nothing more. It is not proof that money changed hands.
  • We cannot recover, reverse, refund or enforce anything. If someone does not pay you, wagr has no ability to compel them and no liability for the outcome. Wager only with people you trust.

4Your account#

  • Provide accurate information and keep your password secure. You are responsible for activity under your account.
  • One account per person. Do not share it or impersonate anyone.
  • Tell us promptly at [CONTACT EMAIL] if you suspect unauthorised use.

5Acceptable use#

Do not use wagr to:

  • Run a betting business, act as a bookmaker, or accept wagers from the public.
  • Wager on anything unlawful, or on outcomes involving minors.
  • Harass, threaten, defraud or impersonate anyone, or post abusive or unlawful content.
  • Wager with anyone under 18, or on behalf of someone else.
  • Attempt to break, probe, scrape, overload or reverse-engineer the service, or access data belonging to others.
  • Fix, manipulate, or wager on events you can influence.

6Your content#

You keep ownership of what you put into wagr — your profile, your messages, your wager descriptions. You grant us a limited licence to store, display and transmit it for the purpose of operating the service (for example, showing your display name to a friend you wagered with). That licence ends when the content is deleted, except where it forms part of another person's record of a shared wager.

You are responsible for your content and confirm you have the right to post it.

7Sports data and odds#

Game schedules, scores and odds come from a third-party provider and are shown for information only.

  • They may be delayed, cached, incomplete, or wrong. Odds displayed in the app can be materially out of date.
  • They do not represent an offer, a line, or a price from wagr — we do not offer odds.
  • Automatic settlement depends on this third-party data. It may fail, settle late, or be unable to settle at all. You and the other person remain responsible for agreeing the actual outcome.

8Records, statistics, and trust indicators#

Win/loss records, balances, streaks and any trust or reputation indicator are calculated from what users have entered. They are informational, may be inaccurate or incomplete, and are not a financial statement, a credit assessment, or a representation about any person's trustworthiness.

9Availability#

We may change, suspend, or discontinue any part of wagr at any time. We may impose limits, and the service may be unavailable during maintenance or for reasons outside our control. wagr is provided on an ongoing best-effort basis and we do not promise any level of uptime.

10Termination#

You may stop using wagr and request account deletion at any time (see the Privacy Policy). We may suspend or terminate your account if you breach these terms, if required by law, or if we discontinue the service. Wagers involving other people may be retained as part of their records.

11Disclaimers#

WAGR IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA, SCORE, ODD OR SETTLEMENT SHOWN IN THE APP IS ACCURATE.

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ONLINE OR OFFLINE, OR FOR ANY FAILURE BY ANY PERSON TO PAY ANY AMOUNT ARISING FROM A WAGER RECORDED IN THE APP.

12Limitation of liability#

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAGR AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR AMOUNTS WAGERED OR OWED BETWEEN USERS, ARISING OUT OF OR RELATING TO YOUR USE OF WAGR.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

13Indemnity#

You agree to indemnify and hold harmless wagr and its owners from any claim, loss, or demand, including reasonable legal fees, arising from your use of the service, your content, your wagers, or your breach of these terms or of any law.

14Governing law and disputes#

These terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. You and wagr agree that any dispute will be brought exclusively in the state or federal courts located in [COUNTY, STATE], and both parties consent to the jurisdiction of those courts.

15Apple#

If you obtained wagr from the Apple App Store, you acknowledge that:

  • These terms are between you and wagr only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for wagr.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, or intellectual-property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
  • You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-parties list.

16Changes to these terms#

We may update these terms. We will change the date at the top and, for significant changes, tell you in the app. Continuing to use wagr after a change means you accept the updated terms.

17General#

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, with the Privacy Policy, are the entire agreement between you and wagr about the service. You may not transfer your rights under them; we may transfer ours in connection with a merger, acquisition or sale of assets.
